Privacy Policy

1. Introduction

This Privacy Policy explains how Zoom Photography Studios Ltd ("we", "us", "our") collects, uses, and protects information when you use SideKick PS software ("the Software"). By using the Software, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

2.1 License Information

When you activate a license, we collect only:

  • Your GoHighLevel Location ID (used as your license identifier)
  • License activation status and expiry date

2.2 Payment Processing

We have no access to your payment card details. All payments are processed securely by LemonSqueezy, our payment provider. Your card information is entered directly on LemonSqueezy's secure platform — we never see, store, or have access to your payment details.

2.3 Information We Do NOT Collect

SideKick PS stores no personal data. The Software operates entirely locally on your computer. We do NOT collect, store, or transmit:

  • Your name, address, or personal details
  • Your client data, contact information, or order details
  • Payment card numbers, bank details, or financial information
  • GoHighLevel API credentials or access tokens
  • GoCardless account credentials or payment data
  • Cardly API keys or greeting card content
  • ProSelect data or XML exports
  • Any data you enter into the Software

2.4 Local Data Storage

The Software stores only configuration settings (such as your preferences and API endpoints) locally on your computer in an INI file. No personal data is stored. This configuration data never leaves your machine and is not transmitted to us or any third party.

3. Third-Party Services

The Software integrates with the following third-party services. Each service has its own privacy policy:

  • LemonSqueezy: Handles all subscription billing and payment processing. Your payment card details are provided directly to LemonSqueezy — we never see or have access to this information.
  • GoHighLevel: CRM data is accessed via your own API credentials and processed locally on your computer
  • GoCardless: Direct Debit functionality connects directly to YOUR GoCardless account using credentials you provide. Customer payment data is transmitted directly from your computer to GoCardless — it never passes through our servers. You are the data controller for your customers' payment information. GoCardless acts as your payment processor, not ours.
  • Cardly International: Greeting card functionality connects directly to YOUR Cardly account using an API key you provide. Image data and recipient addresses are transmitted directly from your computer to Cardly's servers for printing and postage — they never pass through our servers. You are responsible for ensuring recipient addresses and card content are correct. Cardly acts as your print and postal service provider, not ours.

We are not responsible for the privacy practices of these third-party services. Please review their privacy policies separately.

3.1 Your Compliance Responsibilities

When using GoCardless through SideKick, you are the merchant and are responsible for:

  • Complying with GoCardless Terms of Service
  • Following your regional Direct Debit scheme rules (BACS, BECS, SEPA, ACH, PAD)
  • Handling customer disputes and refunds through your GoCardless dashboard

GoCardless handles DDR Service Agreements, payment notifications, and scheme compliance on your behalf. See GoCardless Merchant Terms for details.

When using Cardly through SideKick, you are the account holder and are responsible for:

  • Complying with Cardly Terms of Service
  • Ensuring recipient addresses are correct and that you have consent to send physical mail
  • The content of messages and images printed on greeting cards
  • All charges incurred on your Cardly account (per-card printing and postage fees)

3.2 Disclaimer of Liability

Disclaimer of Warranties: SideKick PS is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied. Zoom Photography Studios Ltd and its suppliers and licensors hereby disclaim all warranties including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or reliability of results, quiet enjoyment, and title. We do not warrant that the Software will be error free or that access will be continuous or uninterrupted. You understand that you use the Software at your own discretion and risk.

Third-Party Services: The license or agreement for GoCardless, GoHighLevel, Cardly International, and other third-party services is between YOU and the service provider. Zoom Photography Ltd is NOT acting as an agent for any third-party service provider and is NOT a party to the license between you and any third-party service provider. Each third-party service provider is solely responsible for their service, warranties (to the extent not disclaimed), and any claims relating to that service. Third-party services may change their APIs, pricing, or terms at any time without notice.

Limitation of Liability: You expressly understand and agree that Zoom Photography Studios Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

  • Damages for loss of profits, goodwill, use, data, or other intangible losses
  • The use or inability to use the Software
  • The cost of procurement of substitute goods and services
  • GoCardless or GoHighLevel or Cardly service availability, errors, or outages
  • Failed payments, chargebacks, disputes, or refunds
  • Data synchronization errors between systems
  • Any loss, damage, or inconvenience arising from third-party integrations
  • Changes to third-party APIs, pricing, or terms of service
  • Any amounts exceeding the fees paid by you in the twelve (12) months prior to the cause of action

Zoom Photography Ltd shall have no liability for any failure or delay due to matters beyond its reasonable control.

Indemnification: You agree to indemnify and hold harmless Zoom Photography Ltd, its contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts (including legal fees) arising from: (i) your use of and access to the Software; (ii) your violation of any terms; (iii) your violation of any third-party right including privacy rights; (iv) any claim arising from incorrect invoices, payments, or client data; (v) any disputes with your customers regarding payments through GoCardless; (vi) your failure to comply with GoCardless, GoHighLevel, or other third-party terms of service.

4. Data Security

Your API credentials and tokens are stored locally on your computer in an encrypted or obfuscated format. We do not have access to your credentials. You are responsible for maintaining the security of your computer and credentials.

5. Data Retention

We retain license activation records for the duration of your subscription plus any legally required period. Uninstalling the Software removes all locally stored data from your computer.

6. Your Rights

You have the right to:

  • Request information about what data we hold about you
  • Request deletion of your license records
  • Cancel your subscription at any time

7. Children's Privacy

The Software is intended for business use by professional photographers. We do not knowingly collect information from children under 16.

8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date.
